These Terms of Service ("Terms") govern your access to and use of the AuBid platform, operated by AuBid LLC ("AuBid", "we", "our", "us"), including our website, auction services, and any related features. By creating an account or placing a bid you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use AuBid. By registering you represent that all information you provide is accurate, current, and complete. AuBid reserves the right to refuse or terminate access for any person who does not meet these requirements or who violates these Terms.
2. Account Registration & Verification
To place bids you must complete our identity verification (KYC) process, which requires submitting a government-issued photo ID. Until verification is approved your account is limited to browsing only. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at office@aubid.com if you suspect unauthorised access.
3. Auction Rules & Bidding
All bids are binding offers to purchase. By placing a bid you agree that if you are the winning bidder you are obligated to complete the purchase at the bid price plus any applicable fees. Bids cannot be retracted once placed. AuBid sets a minimum bid increment for each lot; bids below the minimum will be rejected. We reserve the right to cancel or suspend any auction in the event of a technical error, suspected fraud, or other circumstances beyond our control.
4. Buy Now
Where a Buy Now price is displayed, purchasing at that price immediately ends the auction for that lot. Buy Now transactions are subject to the same payment terms and obligations as winning bids.
5. Fees & Payment
The winning bidder is responsible for the final hammer price plus a buyer's premium and any applicable taxes or transport fees disclosed at the time of sale. Full payment is due within 48 hours of auction close. Failure to pay may result in account suspension and forfeiture of any deposit. AuBid accepts wire transfer and approved electronic payment methods; personal cheques are not accepted.
6. Vehicle Condition & Descriptions
All vehicles are sold as-is, where-is. Condition reports, photographs, and descriptions are provided in good faith for informational purposes only and do not constitute a warranty of any kind. AuBid strongly recommends independent inspection before bidding. Discrepancies between a description and the actual vehicle condition do not constitute grounds for cancellation unless required by applicable law.
7. Title Transfer
Title transfers to the buyer only upon receipt of full payment. AuBid facilitates the transfer of title documents but is not responsible for delays caused by lienholders, government agencies, or courier services. All lots carry a clean title unless explicitly noted otherwise in the lot description.
8. User Conduct
You agree not to: place shill bids or manipulate auction outcomes; use automated tools or bots to interact with the platform without written consent; scrape, copy, or redistribute content; attempt to gain unauthorised access to any part of the system; or engage in any activity that disrupts service for other users. Violations may result in immediate account termination and legal action.
9. Intellectual Property
All content on the AuBid platform — including lot photography, descriptions, logos, software, and design — is owned by or licensed to AuBid LLC. You may not reproduce, distribute, or create derivative works without our prior written permission.
10. Limitation of Liability
To the maximum extent permitted by law, AuBid, its officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform or purchase of a vehicle. Our total liability for any claim shall not exceed the buyer's premium paid by you on the relevant transaction.
11. Indemnification
You agree to indemnify and hold harmless AuBid LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the platform, your breach of these Terms, or your violation of any third-party rights.
12. Modifications
We may update these Terms at any time. Material changes will be communicated by email or prominent notice on the platform at least 7 days before taking effect. Continued use of AuBid after the effective date constitutes acceptance of the revised Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the courts of Broward County, Florida. You waive any objection to jurisdiction or venue in those courts.
